Chartflier is intended for use in accordance with FAA Part 91 operations only use for any other purpose voids all warranty expressed or implied.

You understand that participating in aviation related activities such as, flying, piloting an aircraft acting as a crew member or passenger in an aircraft is dangerous and may kill you and your passengers.

You understand that pilot/operator of the is ultimately responsible to (a) verify that all information being used for navigation or planning is current, up-to-date and valid as verified by the pilot (b) complies with the requirements of 14 CFR part 9, (91.21) to ensure that the use of the EFB does not interfere with the equipment or systems required for flight (c) the in-flight use of an EFB/ECD in lieu of paper reference material is the decision of the aircraft operator and the pilot in command. The pilot/operator understands and agrees to comply with the requirements set forth in FAA AC 91-78, AC 120-76A, and applicable FAA regulations.

ESSENTIAL FLIGHT TECHNOLOGY CUMULATIVE LIABILITY TO YOU OR ANY PARTY RELATED TO YOU FOR ANY LOSS OR DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT, OR INSTALLATION OR USE OF THE SOFTWARE AND DOCUMENTATION SHALL NOT EXCEED THE AMOUNT OF LICENSE FEES PAID TO ESSENTIAL FLIGHT TECHNOLOGY BY YOU UNDER THIS AGREEMENT. THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION OR CLAIMS IN THE AGGREGATE, INCLUDING, WITHOUT LIMITATION, BREACH OF CONTRACT, BREACH OF WARRANTY, INDEMNITY, NEGLIGENCE, STRICT LIABILITY, MISREPRESENTATION, AND OTHER TORTS. IN NO EVENT SHALL ESSENTIAL FLIGHT TECHNOLOGY BE LIABLE TO YOU OR ANY PARTY RELATED TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES OR LOST PROFITS, EVEN IF ESSENTIAL FLIGHT TECHNOLOGY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
